1. Acceptance of Terms
These Terms of Service ("Terms") constitute a binding agreement between the User ("you") and SkiffGhost Labs, Inc., a Delaware C Corporation operating the VaultCare Health brand ("VaultCare Health," "we," or "us"). By accessing or using the Services, you agree to be bound by these Terms.
2. Description of Services
VaultCare Health provides information, membership access, and digital queue or coordination-intent features (collectively, the "Services").
VaultCare Health is not a hospital, clinic, physician, pharmacy, insurer, or emergency service. VaultCare Health does not provide medical diagnosis, treatment, prescriptions, treatment-outcome guarantees, or drug sales, import, transport, or injection services.
3. Eligibility and Account Responsibilities
- Users must be at least eighteen (18) years of age, or the age of legal majority in the User's jurisdiction of residence, and legally capable of entering into these Terms.
- Users must register with a valid email address and are responsible for maintaining the confidentiality of account credentials.
- Users shall not misuse the Services, attempt unauthorized access, or upload unlawful content.
- The Services are not intended for use in medical emergencies. Users requiring emergency assistance should contact local emergency services immediately.
4. Payments
Paid features are processed through Stripe. All payment card information is handled by Stripe in accordance with its own terms and policies.
Billing descriptors on User statements may display a general technology name or an identifier related to VaultCare Health.
5. Refunds and Cancellation
The specific products or services being purchased, applicable pricing, and refund terms are presented on the Pricing page at the time of checkout.
Unless otherwise stated on the Pricing page: membership subscriptions are subject to the cancellation terms displayed at the time of purchase. The one-time Len access coordination fee is refundable while the User is in the queue and has not accepted an allocated slot — a fixed coordination fee is retained on early exit, and if no slot is allocated within six months VaultCare Health automatically grants one additional month of membership. At that point the User may choose to request a full Len access refund, which releases the queue position, or continue waiting with no automatic refund. The right to a Len access refund does not depend on active membership; if membership lapses before the User accepts a slot, the User is removed from the queue and refunded on the same basis. After the User accepts an allocated slot, clinic coordination begins and the Len access fee is non-refundable.
To request a refund, Users should contact support@vaultcare.health with the account email address and payment reference.
6. Third-Party Services
If VaultCare Health subsequently introduces access to third-party services, such services will be governed by the applicable third-party provider's terms unless VaultCare Health expressly states otherwise at that time.
7. Intellectual Property
All content, trademarks, logos, software, and other intellectual property displayed on or through the Services are the property of VaultCare Health or its licensors and are protected by applicable intellectual property laws. Users may not copy, modify, distribute, or create derivative works from any VaultCare Health content without prior written consent.
8. User Content
Users may submit content through the Services, including messages in information tools such as AI consult ("User Content"). Users retain ownership of their User Content.
By submitting User Content, the User grants VaultCare Health a limited, non-exclusive, royalty-free license to use, process, and store such content solely for the purposes of (a) operating and improving the Services, (b) maintaining session history within the User's account, and (c) complying with applicable law. This license terminates upon deletion of the User's account, subject to retention obligations described in the Privacy Policy.
9. Termination and Suspension
VaultCare Health may suspend or terminate a User's access to the Services, with or without notice, if the User violates these Terms, engages in conduct that may harm VaultCare Health or other Users, or as required by applicable law.
The User may terminate their account at any time by contacting support@vaultcare.health. Upon termination, the User's right to access the Services will cease. Sections of these Terms that by their nature should survive termination (including, without limitation, intellectual property, limitation of liability, and governing law) shall remain in effect.
10. Force Majeure
VaultCare Health shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay results from circumstances beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure failures, pandemics, or acts of terrorism.
11. Disclaimers and Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF VAULTCARE FOR ANY CLAIMS ARISING OUT OF OR RELATING TO A PAID SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE USER FOR SUCH SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict-of-law provisions. The state and federal courts located in the State of Delaware shall have exclusive jurisdiction over any disputes arising under these Terms, except where applicable law requires otherwise.
13. Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, and any other policies referenced on the VaultCare Health website, constitute the entire agreement between the User and VaultCare Health with respect to the Services and supersede all prior understandings or agreements.
14. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
15. Modifications to Terms
VaultCare Health reserves the right to modify these Terms at any time by posting a revised version on this website. Continued use of the Services after the posting of modified Terms constitutes acceptance of such modifications.
